Agreeing to the Terms

You (“you,” “your,” “Customer”) agree to these Terms and Conditions by using or accessing any services offered by Wyrdex AS (“Wyrdex,” “we,” “our,” “us”). Please do not use our services if you do not agree to these terms.

What services are offered

Wyrdex offers cybersecurity services, which include but are not limited to:

1. Testing for penetration
2. Compliance and security audits (like NIS2 and GDPR)
3. Threat intelligence and vulnerability assessment
4. Managed security services
5. Digital forensics and incident response
6. Consulting on cloud security
7. Awareness and training

A written agreement between the parties may also allow for custom services.

Who can apply

To use Wyrdex’s services, you must be a legally registered business in the UK or the European Economic Area (EEA) or have permission to act on behalf of such a business.

Agreements for Service

There will be a different Service Level Agreement (SLA) or Statement of Work (SoW) for each engagement that spells out the scope, duration, deliverables, and price. If there is a disagreement between these Terms and the SLA/SoW, the SLA/SoW will win.

Payments and Fees

– The fees are listed in the SLA or SoW.
– All fees do not include VAT or any other taxes that may apply.
– Unless you agree to something else, payment is due within 14 days of the invoice.
– If you don’t pay on time, you might have to pay default interest and your services might be stopped.

What the client has to do

You agree to:

– Give the service provider all the correct and complete information they need to do their job.
– Work with Wyrdex’s staff and give them the access they need to systems.
– Make sure you follow all local, national, and EU laws that apply.
– Do not use our services to break the law or violate the rights of others.

Keeping things private

Both sides agree to:

– Keep any private information you share with each other strictly private.
– Only use it for the reasons given in the agreement.
– Not tell anyone else about it without getting written permission first, unless the law says you have to.
– This clause will still be in effect for five years after the agreement ends.

GDPR and Data Protection

Wyrdex follows the rules set out by the EU General Data Protection Regulation (GDPR). Where personal data is handled:

– Wyrdex is the Data Processor and the Client is the Data Controller, unless the Client says otherwise.
-There will be a separate Data Processing Agreement (DPA).
– Wyrdex will take the right technical and organizational steps to keep personal data safe.

Property of the Mind

Wyrdex owns all of the tools, scripts, frameworks, and methods that it uses or makes.
The Client can only use the reports and deliverables made during the engagement for their own purposes.
It is against the law to copy or share without written permission.

Limiting Liability

As much as the law allows:

Wyrdex will not be responsible for any indirect, incidental, or consequential damages.
The Client’s total liability under any agreement will not be more than the amount they paid for the service that led to the claim.

Protection

You agree to protect Wyrdex, its employees, and subcontractors from any claims made by third parties that come up because you misused the services or broke this Agreement.

Ending

Either side can end the deal with 30 days’ written notice.
If the Client breaks confidentiality or the law, Wyrdex can end the contract right away.
All unpaid fees are due when the contract ends, and access to deliverables may be taken away.

Act of God

Wyrdex will not be responsible for delays or failures to perform that are caused by things that are outside of its reasonable control, such as natural disasters, war, terrorism, cyberattacks, government restrictions, or power outages.

The law that applies and where it applies

Norwegian law applies to these Terms.
Unless the parties agree otherwise, all disputes will be settled only in the courts of Oslo.

Changes

Wyrdex can change these Terms at any time by changing this page. Using our services after changes means you agree to those changes.
